Eligibility for Flat Fees
Our flat-fee structure is available for plaintiff cases involving straightforward claims such as unpaid invoices, breach of contract, and basic collections where the total claim value is between $10,000 and $35,000. This structure covers all services up to and including the settlement conference or obtaining a default judgment.
Services Covered by the Flat Fee Structure

Initial Consultation and Case Assessment
- Flat Fee: $300
- Includes a one-hour virtual consultation to discuss your case details, assess its merits, and outline the Small Claims Court process. We will provide you with an honest evaluation of your claim and the potential for recovery.

Preparation and Filing of Plaintiff’s Claim
- Fee: 7.5% of the claim amount (e.g., $750 for a $10,000 claim) plus disbursements.
- Services include:
- Drafting and filing the Plaintiff’s Claim.
- Serving the Defendant with the claim documents.
- Managing correspondence and court filings up to the settlement conference.

Settlement Conference or Default Judgment
- Fee: Additional 7.5% of the claim amount (e.g., another $750 for a $10,000 claim) plus disbursements.
- Applicable when:
- Attending the settlement conference.
- Securing a default judgment if the defendant does not respond.
- Services include:
- Preparing for and representing you at the settlement conference.
- Negotiating with the defendant (if present) to reach a fair settlement.
- Filing necessary motions or applications to obtain default judgment, if required.

Further Steps Beyond the Settlement Conference
- If the matter proceeds beyond the settlement conference or requires additional steps such as trial preparation or enforcement of judgment, these services will be billed at our general hourly rate of $300 per hour, or we can discuss a customized flat fee agreement.
What Are Disbursements?
Disbursements are additional out-of-pocket costs incurred on your behalf during the litigation process. These may include:
- Court Filing Fees: Fees for filing the Plaintiff’s Claim and other court documents.
- Process Server Fees: Costs associated with serving documents to the defendant.
- Postage and Courier Costs: If required to send documents or evidence.
- Other Expenses: Any other necessary costs related to your case.
We will provide an estimate of these disbursements at the outset and keep you informed of any additional costs as your case progresses.
What’s Not Covered by the Flat Fee?
The flat-fee structure is designed for straightforward cases and covers most steps up to the settlement conference or default judgment. However, the following are not included:
- Defending Counterclaims: If the defendant files a counterclaim, additional fees may apply.
- Trial Representation: If the case proceeds to trial, further steps will be billed at our general hourly rate or under a new agreement.
- Complex Matters: Cases involving multiple parties, complex legal issues, or substantial document review may not be eligible for the flat-fee structure.
